Patent law and utility model law regulate the protection of technical inventions and are essentially: Patent Act (PatG) and Utility Model Act (GebrMG) regulated. By granting a patent or registering a utility model, the inventor/owner is granted the right to use his invention exclusively for himself and to prohibit anyone else from using it (exclusive right). This monopoly-like protection of a technical teaching requires registration of the property right and only arises when it is entered in the register - but then retroactively. The maximum period of protection for a patent is 20 years for both the German and the European patent, and 10 years for the utility model. Before or independently of registration, protection of technical knowledge (technical know-how) can only be guaranteed through secrecy.
Especially in Baden-Württemberg, as a model country in the area of technical research and development, there is a large number of traditional companies, medium-sized companies with global market power (“hidden champions”) and other companies with great innovative strength. However, in the face of global competition and changing markets, these too always require new incentives and developments that cannot always be provided from within our own ranks.
