The dispute between Moses Pelham and Kraftwerk regarding the admissibility of sound carrier sampling is entering its next round. The Federal Court of Justice has decided under what conditions the rights of the sound carrier manufacturer are violated by sampling.

The manufacturer (author) of software can effectively restrict the power of disposal regarding the granted right of use with real effect, such that it cannot be further assigned.
