43 Abmahnungen pro Woche rechtsmissbräuchlich?
Ein Online-Händler hatte durch seinen Rechtsanwalt in einer Woche 43 Wettbewerber wegen verschiedener Wettbewerbsverstöße abmahnen lassen. Dabei hatte der Online-Händler sehr kurze Fristen zur Abgabe einer Unterlassungserklärung gesetzt. Das Oberlandesgericht Hamm hatte nun zu entscheiden, ob diese Abmahntätigkeit rechtsmissbräuchlich ist.
Loss of legal standing in the case of mass warnings
The judicial determination of abusive prosecution due to serial warnings (multiple warnings) pursuant to Section 13 (5) UWG results in the loss of the right to sue as a competitor. This does not apply in perpetuity if the person issuing the warning letter demonstrates significant changes in the relevant circumstances of the legal action which now make it appear to be fair.
