Rabatte auf preisgebundene Arzneimittel unzulässig
Nach Auffassung des Oberlandesgerichts Karlsruhe verstößt die Abgabe von Bonustalern beim Erwerb von preisgebundenen Arzneimitteln gegen § 78 Arzneimittelgesetz (AMG) und §§ 1, 3 Abs. 1 der Arzneimittelpreisverordnung (AMPreisV) und ist wettbewerbswidrig (OLG Karlsruhe, Urteil vom 12.02.2009 – 4 U 160/07).
Bonus system for prescription drugs inadmissible
The subject of the dispute was the discount system of a pharmacy, which provides for the granting of a bonus on the purchase of prescription drugs. On presentation of the completed bonus card, the pharmacy granted a discount of EUR 10.00 on the purchase of non-prescription medicines or reimbursed the practice fee paid by the customer.
